Warranty

Price, payment and warranty conditions Price The prevailing selling prices are the prices in effect at the time this price list is sent; they are subject to change without notice. All prices indicated are the manufacturer's suggested retail prices in CAD ($)/USD ($) and are subject to a trade discount determined by MAAX Bath Inc., or its subsidiaries (hereinafter collectively "MAAX"). Orders will be invoiced at the selling prices prevailing on the order date. Selling prices may be adjusted without notice if, for example, an increase in transportation costs related to an increase in fuel costs occurs during the year. Conditions of acceptance Acceptance, shipment, and delivery of any order are subject to approval by MAAX's credit department and these terms and conditions of sale applying to the order. No other terms and conditions shall apply unless expressly agreed to in writing by MAAX. MAAX reserves the right to request satisfactory purchase warranties from the purchaser prior to shipment of an order. All merchandise received remains the sole property of MAAX until paid for in full, in accordance with applicable laws, such as the Uniform Commercial Code - Sales in the United States. Payment terms Payment terms are: net within 30 days. Interest at 2% per month (26.82% per annum, compounded monthly) will be calculated on any overdue account. No deliveries will be made to customers who do not meet these terms. Taxes All applicable sales taxes must be added to published prices. Lost merchandise If, upon receipt of a shipment, the recipient notices that certain products are missing, they must immediately inform MAAX customer service or the relevant MAAX subsidiary. They must then indicate the missing items on the delivery slip and countersign it. The bill of lading included with the shipment allows them to verify the goods shipped and received. Damage attributable to shipping MAAX assumes no liability for shipping damage, which is the responsibility of the carrier. Upon receipt of the merchandise, the user or installer must carefully examine it to ensure that it is free of damage. If not, the user or installer must note the observed damage on the freight bill and submit a claim to the carrier as soon as possible. Before installing the product, the installer, the contractor hired by the user, or the user themselves are responsible for inspecting it and ensuring that it is not defective or damaged. If they notice a problem, they must not proceed with the installation. MAAX is not responsible for any failures, costs, damages, or claims that could have been discovered, repaired, or avoided through proper inspection and verification prior to installation. Return policy MAAX has a selective and conditional merchandise return program. For doors, refer to the door return policy below. Products may be returned to MAAX under the following conditions: The product is in its original and new condition — it has never been installed or used on display; The customer has had the product in his possession for less than eight (8) weeks; The product is still on the most recent price list and has not been announced as discontinued; The product is of a standard color or finish as indicated on the most recent price list; Any “stock” product may be subject to return. Please contact your customer support department to determine if the product in question is a “stock” product; or The product was received in error, does not match the customer's order, or has a manufacturing defect. It is not possible to return products to MAAX under the following conditions: The product has been previously installed, drilled into, permanently marked, spray painted, or altered in any way from its original condition; The product is altered or degraded as a result of outdoor storage or exposure to the elements that has caused it to discolor; The product has become defective as a result of negligence in storage; or The product is equipped with accessories or options. Before returning merchandise, the MAAX customer must complete a return request in the Partner Portal or complete and submit an RGA request form, including general and merchandise-specific information. MAAX must then authorize and approve the return in writing, issuing an RGA number. All products are inspected prior to any refund, and MAAX reserves the right to reduce the refund amount as follows: MAAX will charge a 25% restocking fee on the refund credit for returns not attributable to a manufacturing defect or MAAX error. A repair fee will be charged to the credit refund when a repair is necessary to restore the product to a perfect resalable condition. MAAX will notify the customer if this is the case. In the case of an item returned by carrier, the customer will have to pay the transport costs. For any product returned without qualifying under the conditions set out above or not in accordance with the instructions on the RGA form, MAAX will charge a $25 handling fee per item. MAAX will notify the customer and the customer must either take back the item and assume the shipping costs, or notify MAAX in writing of its authorization to destroy the item. Interview CUSTOMERS MUST INFORM THE OWNER OR END USER OF THE FOLLOWING CONDITIONS AND WARRANTIES Regular disinfection is an excellent way to prevent the types of bacteria that can grow in bathtubs and showers over time. For daily maintenance, use a damp cloth and a mild liquid detergent. For acrylic surfaces, applying a special cleaner such as Lumashine or Lumacream will add shine and protect the finish. Certain types of therapeutic products, when added to the bath water or when applied undiluted directly into the bath, may damage the unit's finish. Before using the product, test it on a small, inconspicuous area of ​​the unit. Never use abrasive cleaners, scrapers, wire brushes, or other objects or products that may scratch or dull surfaces. Mirrors should only be cleaned with an ammonia-free cleaner. Certification MAAX products are certified by one or more of the following certification bodies: UL, IAPMO, INTERTEK (ETL), and WARNOCK HERSEY. Some models are pending certification. If the product was sold by MAAX for installation in a display setting, the standard MAAX product warranty applies. Restrictions This warranty does not apply to improper or incorrect use or operation, breakage or damage caused by normal wear and tear, fault, negligence, abuse, misuse, improper maintenance, alteration or modification of the product, as well as chemical or natural corrosion, fire, flood, natural disasters or any other fortuitous event. This warranty does not apply to stains and malfunctions caused by ferrous, hard or salt water. The owner/user of the product covered by this warranty is entirely responsible for the proper installation and connection of the appliance. This warranty is void if, prior to permanent installation of the product, it has not been tested in accordance with the installation instructions provided by MAAX. MAAX does not perform the installation, does not hire a contractor for this purpose, nor does it supervise the installation and, consequently, cannot be held responsible for any defect, breakage or damage caused directly or indirectly by or resulting from the installation of the product. The owner/user must ensure access to the product components as described in the installation guide in order for MAAX to execute the warranty specified herein. If such access does not exist, all costs inherent in its provision will be the responsibility of the owner/user. This warranty does not apply to products that have not been installed or used in accordance with the instructions provided by MAAX and any regulations or laws applicable to such installations. MAAX strongly recommends that its products, such as its shower doors, be installed by professionals specializing in bathroom products. Inexperienced shower door installation can result in broken glass, resulting in injury or death. MAAX is not responsible for any costs, damages or claims resulting from the purchase of products that do not fit into existing openings or structures. MAAX is not responsible for any costs, damages or claims resulting from defects that could have been discovered, repaired or avoided during an inspection or verification prior to installation. MAAX is not liable for any personal injury, death of any person, direct, special, incidental or indirect damages, loss of use, loss of time or profit, inconvenience, incidental expenses, labor or material costs or any other costs resulting from the use of its products or relating to the application of this warranty or resulting from the removal or replacement of any product, element or part covered by this warranty. EXCEPT AS OTHERWISE PROVIDED HEREIN, MAAX MAKES NO EXPRESS OR IMPLIED WARRANTIES, NOR ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR COMPLIANCE WITH ANY CODE. In any event, MAAX cannot be held liable for any amount exceeding the purchase price of the product paid by the owner/user, contractor or builder. All options not sold separately as accessories must be factory installed, otherwise the warranty does not apply. This warranty gives the owner/user specific legal rights, and the owner/user may have other rights which vary from province to province or state to state. Limited warranties MAAX offers the following express limited warranties on its products. These warranties apply only to the owner/end user for personal household use and begin on the original date of purchase. Additional restrictions apply to commercial uses. MAAX warrants acrylic products against defects in material or workmanship under normal use and maintenance for a period of twenty-five (25) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants its acrylic shower kits against defects in material or workmanship under normal use and maintenance for a period of ten (10) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants Utile units against defects in material or workmanship under normal use and maintenance for a period of ten (10) years from the date of initial purchase of the product by the owner/user, contractor or builder from an authorized distributor. MAAX warrants AcrylXTM products against defects in material or workmanship under normal use and maintenance for a period of twenty-five (25) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer.* *Our Lifetime Limited Warranty first came into effect in 2017 when ABG launched AcrylXTM, the revolutionary applied acrylic finish. Prior to 2017, warranties for fiberglass products were three (3) or five (5) years depending on the brand. Any product manufactured before 2017 is not covered by the Lifetime Limited Warranty. MAAX warrants fiberglass products against defects in material or workmanship under normal use and maintenance for a period of five (5) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants the ABS against defects in material or workmanship under normal use and maintenance for a period of three (3) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants its polystyrene shower sets, tub surrounds, laundry tubs and accessories against defects in material or workmanship under normal use and maintenance for a period of one (1) year from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants whirlpool motors and pumps against defects in material or workmanship under normal use and maintenance for a period of five (5) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants its blowers against defects in material or workmanship under normal use and maintenance for a period of five (5) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants its whirlpool and air systems (except for the check valves of perimeter air systems which have a 25-year warranty – see below) against defects in material or workmanship under normal use and maintenance for a period of two (2) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants the perimeter air system check valves against defects in material or workmanship under normal use and service for a period of twenty-five (25) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants its shower doors against defects in material or workmanship under normal use and maintenance for a period of ten (10) years from the original date of purchase by the owner/user, contractor, or builder from an authorized retailer. Shower door materials and seals are not covered by this warranty. *The Mika door has a one (1) year limited warranty. MAAX warrants that GlassShield Film (Anti-Shatter Film) will be free from defects in material and workmanship for a period of five (5) years from the original date of purchase, subject to normal use and care. MAAX warrants its shower doors against defects in material or workmanship under normal use and maintenance for a period of ten (10) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX offers a limited lifetime warranty on the ceramic faucet cartridges against leaks under normal use by the owner/user, contractor or builder. MAAX warrants polysulfone thermostatic cartridges for life against defects in material or workmanship under normal use and service from the original date of purchase by the owner/user, contractor or builder from an authorized retailer. MAAX offers a limited lifetime warranty on pressure-balanced cartridges against defects in material or workmanship under normal use and service from the original date of purchase of the product by the owner/user, contractor, or builder from an authorized retailer. MAAX warrants its chrome, polished brass and brushed nickel faucet finishes for life against defects in material or workmanship under normal use and maintenance by the owner/user, contractor or builder. MAAX warrants medicine cabinets against defects in material or workmanship under normal use and maintenance for a period of five (5) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants its shower massage systems against defects in material or workmanship under normal use and maintenance for a period of five (5) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants glass mirrors against defects in material or workmanship under normal use and maintenance for a period of two (2) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants electrical components, including chromotherapy systems, against defects in material or workmanship under normal use and maintenance for a period of two (2) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX warrants factory-treated wood parts against defects in material or workmanship under normal use and maintenance for a period of two (2) years from the original date of purchase of the product by the owner/user, contractor or builder from an authorized retailer. MAAX will repair or replace (with a product of equal value), at its discretion, any product reported defective to the authorized retailer or MAAX during the warranty period. Delivery charges for replacement products or parts may be charged to the owner/user of the product. Under no circumstances is MAAX responsible for the cost of repairing or replacing installation materials, including but not limited to ceramic, marble, etc. This warranty applies to the original owner/user and is not transferable to a subsequent owner. Neither the MAAX distributor nor the authorized MAAX dealer nor anyone else is authorized to make any affirmations, representations or warranties other than those stipulated herein; affirmations, representations and warranties contrary to this prohibition shall not apply to MAAX or anyone else. MAAX reserves the right to modify this warranty at any time; it is understood that such modifications will not change the conditions of the warranty applicable at the time of sale of the products in question. Service guarantees To obtain service under this warranty during normal business hours, contact the retailer or distributor who sold the product, or contact MAAX directly. MAAX will honor the service warranty described above under the following conditions: (1) the failure is of a nature or type covered by the warranty; (2) the user has informed an authorized MAAX agent or warranty service representative of the nature of the problem during the warranty period; (3) conclusive proof (e.g., serial number or proof of purchase) of the foregoing is provided by the user, demonstrating that the failure occurred or was discovered during the warranty period; and (4) an authorized person from an independent service or a representative of the company has been permitted to inspect the product during normal business hours, within a reasonable time after the user reports the problem. MAAX's warranty obligation ceases when MAAX provides the replacement or repair. The customer's refusal to accept this measure terminates MAAX's warranty obligation. Any product replaced or repaired during the warranty period will be covered for the remainder of the original warranty period.

For larger or more delicate items, delivery is provided through our home delivery service. Fees are calculated based on the distance from our Mascouche branch. We cannot refund or cancel the order of a custom product.

Check the material before installing it as errors may occur at the factory or during delivery. No complaints will be accepted after installation.

Our liability is limited to reimbursement of the value of the equipment if it is established that it is defective. Damaged goods must be reported with photos within 48 hours to service.client@plomberielpm.ca. Variations in tones, graining and calibrations are normal phenomena.
